Welcome to Escourtly. These Terms of Service ("Terms") govern your access to and use of our platform, including our website, dashboard, SDK, and Chrome extension (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Services.
1. Acceptance of Terms
By creating an account, accessing our dashboard, installing our Chrome extension, or embedding our SDK on your website, you agree to these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Escourtly provides a platform for creating and managing interactive product tours and onboarding guides for web applications. Our Services include:
- Dashboard: Web-based interface for managing workspaces, guides, and analytics
- Chrome Extension: Visual guide builder for creating tours directly on target websites
- SDK: JavaScript library for displaying tours on customer websites
- API: Backend infrastructure for guide management and analytics
3. Account Registration
3.1 Account Requirements
- You must be at least 13 years old to create an account
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
3.2 Account Responsibilities
You are responsible for all activities that occur under your account. You agree to:
- Keep your password secure and confidential
- Not share your account with others
- Use strong authentication practices
- Notify us of any security breaches
4. Workspaces and API Keys
4.1 Workspace Management
- Each workspace receives a unique API key for SDK authentication
- You are responsible for securing your API keys
- API keys should not be shared publicly or committed to public repositories
- You can regenerate API keys at any time from your dashboard
4.2 Team Members
Workspace owners can invite team members. Owners are responsible for all actions taken by team members and must ensure team members comply with these Terms.
5. Chrome Extension Usage
5.1 Permitted Use
- The Chrome extension is provided for building product tours on websites you own or have permission to modify
- You may only use the extension on websites where you have authorization to create guides
- The extension must not be used to collect data from third-party websites without permission
5.2 Required Permissions
The extension requires certain browser permissions to function. By installing the extension, you grant these permissions:
- activeTab: Access current webpage for element selection
- scripting: Inject guide builder interface
- storage: Store guide builder state locally
- cookies: Read authentication session
- host permissions: Build guides on any website

6. SDK Integration
6.1 License Grant
We grant you a limited, non-exclusive, non-transferable license to use the Escourtly SDK on websites you own or operate, subject to your compliance with these Terms.
6.2 SDK Requirements
- You must use a valid API key associated with your workspace
- You must not modify, reverse engineer, or create derivative works of the SDK
- You must comply with all applicable laws when using the SDK
- You must not use the SDK to display misleading or fraudulent content
7. Acceptable Use Policy
You agree not to:
- Violate any laws, regulations, or third-party rights
- Use the Services for any illegal or fraudulent purpose
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any part of the Services
- Use automated systems (bots, scrapers) without permission
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity
- Harass, abuse, or harm other users
- Collect user data from websites without consent
- Resell or redistribute the Services without authorization
8. Content Ownership and Rights
8.1 Your Content
You retain all rights to the content you create using our Services (guide titles, descriptions, configurations). By using the Services, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Services.
8.2 Our Content
Escourtly and its original content, features, and functionality are owned by Escourtly and are protected by international copyright, trademark, and other intellectual property laws.
9. Subscription and Payment
9.1 Free Plan
We offer a free plan with limited features. Free accounts may have usage limits and restricted functionality.
9.2 Paid Subscriptions
Payments for Escourtly are processed by our Merchant of Record, Polar.sh. Polar handles all billing, payment processing, and sales tax/VAT compliance. When you purchase a subscription:
- You are purchasing access to Escourtly's digital services
- Paid plans are billed monthly or annually based on your selection
- Subscriptions automatically renew until cancelled
- We reserve the right to change pricing with 30 days' notice
9.3 Refund Policy
Refunds are provided by Polar, our payment processor. If you are not satisfied with your purchase:
- You may request a refund within 14 days of your initial purchase
- Refund requests should be submitted to Polar via their support channels or by contacting us at [email protected]
- Refunds are processed using the same payment method used for the original transaction
- After the 14-day period, refunds are provided at Polar's discretion on a case-by-case basis

9.4 Cancellation
You may cancel your subscription at any time. To cancel, please contact us at least 48 hours before your next billing date. Cancellation will take effect at the end of your current billing period. There are no refunds for unused subscription periods after the 14-day refund window.
10. Data and Privacy
Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.
11. Service Level and Availability
- We strive to provide reliable Services but do not guarantee 100% uptime
- We may perform scheduled maintenance with reasonable notice
- We are not liable for service interruptions caused by third-party providers or events beyond our control
- We reserve the right to modify or discontinue features with notice
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting [email protected] or through the dashboard settings.
12.2 Termination by Us
We may suspend or terminate your access to the Services at any time if:
- You violate these Terms or our Acceptable Use Policy
- Your account is involved in fraudulent or illegal activity
- You fail to pay applicable fees
- We are required to do so by law
12.3 Effect of Termination
Upon termination, your right to use the Services ceases immediately. We will retain your data for 30 days to allow for recovery, after which it will be permanently deleted. You may request immediate deletion by contacting support.
13. Disclaimers and Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any content
You use the Services at your own risk.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCOURTLY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Third-party actions or content
Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless Escourtly, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or submit through the Services
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through good faith negotiation or, if necessary, through binding arbitration or the courts of competent jurisdiction.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the dashboard at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
18. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Escourtly
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- Waiver: Failure to enforce any provision does not constitute a waiver
- Assignment: You may not assign these Terms without our consent
- Force Majeure: We are not liable for delays caused by events beyond our reasonable control
